Abstract
The present article focuses on the ree.use:of copyrighted materials for private purposes in the German copyright system : The free use exception :is one of the most important parts of the copyright statutes nowadays, for it makes clear the rights and limitations of:thé public to use the copyrighted expressions of others — without the consent of the author and any payment due: This work after introducing the theoretical basis•.of free use and .making the necessary distinctions from the other utilization types (use :contract; statutory licenses etc.) - concentrates only on one part of free uses: the private copying .exception.:Tle'reader: can get familiarized with the statutory provisions andcourt practice concerning this issue, for example in relation to copying for private or any other personal purposes, .file sharing systems:("P2P systems".), databases, photo copying through libraries, archives, royalties etc. The article refers to the forthcoming amendments of the so called "Zweiter Kocb" ("Second basket") that will modify partlythe present issue (and mainly the royalty. system) in large details.
