Abstract
The right of disposing of property and real estate management is important, inseparable part of the local government authority. Although this right entitled to the common of the settlement, local self-governments could only practice this right within the limits – set in Act in the 19th century also. The paper focuses on these checks: how the county authority could practice control function, what questions were in the centre of the supervising and whether the authority exceeded its mandate. The essay shows the historical development process of the elements of self-government from 13th century, until the law regulation at the end of 19 the century in brief. The right of self-government contained the following elements: the community could decide on own home affairs, adopt regulations, dispose on properties, levy taxes, maintain schools and other institutions. The affairs of the state and the local authority were by no means separated. The local government performance tasks and responsibilities of the state in own territory. The next chapter of the study is based on results of research carried out in Historical Archives of Csongrád County, where the protocols of county authority of 1890 and 1891 years were examined. The paper involves different cases on the subject matter of real estate management, when the county authority required different conditions in order to the decisions be approved, especially budget conditions. The self government bodies were not satisfied in every case with the requirements of the county authority, they could appeal to the Minister of Home Affairs. Finally we can conclude that check of county authority on one hand have had slowing down effect on practising of real estate managing of the settlements, on the other hand provided the regular manner and legality of the decision making processes.
