Absztrakt (kivonat)
The purpose of my study is the introduction and the examination of the national legislative and judicature troubles in connection with the compulsory hospital treatment as a measure for incarceration. The European Court of Human Rights has condemned Hungary recently on several occasions because of the violation of the person’s right to liberty insured in the Article 5 of the European Convention on Human Rights that was related to the court order of the compulsory hospital treatment among others. The European Court of Human Rights in its judgments given against Hungary called the attention to some problems of the Hungarian legislative and to the troubles of the national judicature of court, so in particular to the low level of the individualization and the summary argument of the decisions. In my study, I present the role of the Hungarian courts in the cases of the Court of Strasbourg, the international and national regulation of the right to liberty in connection with the compulsory hospital treatment, the Article 5 of the European Convention on Human Rights (right to liberty and security), further the case – law of the Court of Strasbourg, some Hungarian cases in breach of the Convention and the most important national legislative and judicature troubles. In the last part of my study, I describe some possibilities of correction of the national legislative and judicature that suit the requirements of the European Court of Human Rights.
