Visitation is the child’s basic right, and the right and obligation of the parent. There are numerous international agreements, recommendations, regulations, sentences dealing with this question, which is significant indeed. Nowadays it sounds like a cliché that every other marriage ends up in divorce, and as a result, year by year thousands of children are affected by family splitting. When the marriage ends, it is needed to agree not only on possessions, but also on the common minor’s further life. During the child custody decision the parents need to agree on which of them the child will live with, and how much child support the other will pay. In every situation the most extended visitation should be provided so that the child’s and the separated parent’s relationship would not exclusively mean financial care. In my study I investigated difficulties arising during visitation from both psychological and legal point of view. By now it is obvious for everyone that the threat experts had been talking about for decades did mean a real problem. Children growing up in a single parent family are facing countless difficulties, however, the most important of all and the crucial point is what pattern they bring to their adult life, and to what extent this pattern influences their willingness to start a family with their chosen partner. During visitation difficulties come up when the separated parent doesn’t want to take his/her right, or misuses it, or uses it only to vex the other one. The most common case is when the custodian parent prevents the child from meeting the other parent. If the child refuses visitation, it is mostly due to the spoilt relationship between the two parents. Finally, the rarest case is when the child-parent relationship is so bad that the visitation becomes impossible. In my view, these difficulties coming up from family split up are all avoidable as long as both parents consider keeping the child-parent relationship tight and good. It is mainly the parents’ responsibility. To achieve this, the State provides help only in extreme cases since it intervenes into family law affairs only in need.
