The decree (1439) of Albert of Habsburg of Hungary (1437-1439) was one of the cornerstones of the Hungarian (feudal) constitution. Although the reign of Albert of Habsburg was not an emblematic period of the Hungarian history but on the perspective of the public law was. In 1437 Albert as husband of Elisabeth of Luxemburg of Hungary was elected king of Hungary after the death of Emperor Sigismund of Luxemburg of Hungary. However the ambitious Princess Elisabeth wanted to take significant part of the power against her husband, and she tried to achieve that with the help of the barons and the nobility. The Estates of the realm took an advantage of the situation of the ambitious wife of Albert, and forced the king to issue the decree of the assembly of Buda of 1439. We could diagnose that the provisions of the decree in question reflected more the half-century long governance of Sigismund of Luxemburg of Hungary (1387-1437) than the one and half year long reign of Albert. The Estates of the realm reached numerous constitutional and political rights and charged the expanses of the defence to the king. The declaration of the common election of the palatine both by the assembly and the king was also a key position to the Estates of the realm. We could grade the provisions of the decree in different classes. These affected the fiscal and monetary policy, the donation of public offices and estates, the system of the justice and the positions of the noble counties. The decree was a really important constitutional found to the Estates of the realm to be able to preserve the dualism of the power between the king and themselves.
