Abstract
The European Union is struggling with the problem of cartels for decades now. In the field of private enforcement the member states had really different regulations, and only a few person started a case in the national courts. To ease this problem, in 2014 the Directive about private enforcement came into force and the member states had to implement it until the end of 2016. Although that’s a huge step in this area, we still have problems for example with the evidences, or proving the damages. The European Union has to realise that the example of the United States of America can help to make the system and the regulation more effective.
