Abstract
Citizenship is one of the most interesting parts of constitutional law which defines who construct the population of a country in legal sense. Thus the legislation has dealt with the regulation on citizenship since the early 18`h century and has determined the acquisition and loss of citizenship and the relating procedures. . The essay focuses the regulation between 1945 and 1950 and gives general outlook on the earlier Acts. The aforesaid period of time introduced important alterations to the field of citizenship; after the world war the territory of Hungary had been modified, the regulation of citizenship had become decentralized, in many ways it had been controlled by decrees. The Act on the Hungarian citizenship in 1948 came revolutionary, it standardized the law but in some ways political aspects proved to be severe. The essay deals with the deprival of citizenship which was part of the Hungarian legal order until 1993. In most cases deprival was issued against those who committed felonies against the state, like treason. Thus the institution can be interpreted as secondary punishment of criminal law; however, huge differences can also be made. Deprival was not ordered by the Court but by the bodies of the executive power, no remedies could be made, was collective (it might have escalated to the family members) and was a sanction with objective basis (neither intentionality nor negligence was required). So it was out of the constitutional guarantees the criminal punishment had. Although the Act was not in effect for a long time, due to some political and international reasons a new Act was made in 1957, its importance in the field cannot be doubted.
