It is well known that the European Convention on Human Rights has had a considerable impact on the evolution of community law. However, the . relationship between community law and the Convention has been and remains to be controversial. Given the fact that the European Union itself is not contracting party to the Convention, the European Court of Human Rights has neither jurisdiction to address the responsibility of the Union,' nor power to question directly the compliance of community law with the Convention. Recent developments in the case law of the Court of Human Rights however show that the latter has found the means to scrutinize compliance of community law with the Convention by raisig the question of the contracting states' responsibility when implementing community law. In its judgement delivered in the Bosphorus Airlines case the Court of Human Rights has confirmed that contracting parties to the Convention cannot be absolved from their Convention responsibility in the areas covered by a transfer of competences to an international organization. However, in the Court's view, state actions taken in accordance with legal obligations arising from membership in such international organizations are justified as long as the relevant organization is considered to protect fundamental rights, as regards both the substantive guarantees offered and the mechanisms controlling their observance, in a manner which can be considered to be at least equivalent to that provided by the Convention. The Court of Human Rights went on to observe that the protection of fundamental rights by community law can be considered to be "equivalent" to that of the Convention system, thus the presumption arises that member states do not depart from the requirements of the Convention when they implement legal obligations arising from their membership in the European Union, a presumption which remains to be rebutted if in a particular case the protection of Convention rights are considered to be manifestly deficient. It follows that the Court of Human Rights has secured itself the powers necessary for scrutinizing community law, but has at the same time made it clear that it does not wish to exercise such powers as long as the European Union guaranties an appropriate level of fundamental rights protection. It remains to be seen if the Court of Human Rights will indeed exercise self-constraint in the next years, pending accession of the European Union itself to the Convention, an event that is likely to thoroughly restructure the current system of fundamental rights protection in Europe.
