The rules of the sale of goods and tenement contracts in ancient rome were so similar to each other that even for roman jurisprudents it was difficult to qualify some cases. Also contributed to this fact was that the concept of antique locatio conductio was much more broader than the modern tenement contracts. So the research paper focuses on the three manifestational forms of antique tenement and also observes the borderline cases of sale of goods. All this of course is looked at from the point of view of monetary compensation, in other words, in cases which are utterly similar, which are the ones where in case of tenement, a rent (merces) is being payed, and which are the ones where purchase price (pretium) is being payed, thus conducting a chaffer. First of all, it should be highlighted that monetary compensation is an important part of the contract in both cases. Also a common element of the two types of contracts is the possibility of circumscriptio. A sin the case of sale, it was permissible to cheat the other, in case of the rent price, also the aspects of suppy and demand were the decision making factors, so the price-value relationship was irrelevant. It is still important to note that the phrase „circumscribere" in other words, the bluffing of the other, can only be understood by the „fides"-conform, and not to be equaled with deception and fraud. The survey reaches the conclusion that it is difficult to determine and separate cases of rent and purchace because of the common rules of compensation — like monetary compensation, the possibility of circumscriptio, and determining the price of rent/sale by a third person. Albeit the basic principles of deciding which cas eis which are given — in case of sale, conveyance of property is happening, and that rent is a permanent legal relation etc. — the sources examined prove that it is still not easy to demarcate certain cases. Of course, demarcation cannot be selfish, since it is important in several ways: like describing liability, danger and monetary compensation in terms of legal' consequences.
