Abstract
The preparation of my thesis was motivated by the presentation of maintaining contact as a child’s right. I did not work on the topic according to the usual structure of the curriculum and legislation. The aim of my interdisciplinary approach – partially developed as a result of my own five-year practical research – is to examine the institution of contact in the context of child protection, fundamental, criminal and international law along the lines of features that are emphasized from the point of view of practice. That is why the thesis not only deals with decisions made by the Kúria or the courts, but also by many district courts. The topicality of the topic is supported by its complexity, the continuous development of the law attached to it, and the need to follow the changes affecting the legal practice that followed. The in-depth regulation of family relationships is not a characteristic of Hungarian law so even in the case of legal disputes moral and ethical norms appear more prominently. The protection of these – most important – personal relationships and the child-centered, moral and ethical enforcement of law enforcement in them represent a significant challenge for those involved as well as for law enforcement. The issue of maintaining personal relations and direct contact with children is persistently current and due to its continuous development, it is also characterized by constant renewal. In my research I looked for an answer to what kind of changes the recent legislative changes and the constantly evolving jurisprudence have brought about in the voluntary provision of contact its protection and promotion by the legal practitioner compared to the previous decades-long framework of law. In my investigation I also explored and evaluated the results of changes in jurisdiction and the possibility of ordering joint parental custody as a judgment.
