Absztrakt (kivonat)

After 1 January 2021, the legislator criminalised corruption in the provision of health services, i.e. the giving of gratuities. In my thesis, I conducted a subject-centred dogmatic and criminal policy analysis of the new offence, focusing on the question of whether this offence has a place in the criminal law system. I have analysed the concept of benefit and its principled adequacy, and I have examined the potential liability exclusionary effect of the relevant provisions of the Labour Code by including the authorisation of the act in the factual analysis of the offence in an interdisciplinary manner. In my thesis, I have pointed out the fundamental-dogmatic as well as the criminalpolitical dysfunctions of the norm, and I have set out my conclusions in a de lege ferenda proposal.
