The Court of Justice of the Europe Union has developed a line of reasoning in his caselaw that Member States are subject to the obligation to observe EU law also in nationality matter. These citizenship issues take on a transnational dimension by influencing access to status and rights throughout the EU. Loss of citizenship, therefore, is not an isolated event that only affects an individual’s national status, but affecting his or her position and rights within the entire European Union. With this competence, however, the Court proceeded to legitimize highly controversial objectives, such as the preservation of the genuine link. The origins of the contemporary understanding of nationality as a genuine link can be traced to the famous International Court of Justice (ICJ) judgment Nottebohm from 1955. Yet the doctrine’s dubious legacy persists and thrives. It also features in the judgments in Rottmann and Tjebbes through the ECJ’s uncritical acceptance of a genuine link as justification for depriving some individuals of their nationality, in order “to protect the special relationship of solidarity and good faith between it and its nationals and also the reciprocity of rights and duties. In the newest case the Court of Justice examines the ipso iure loss of Danish nationality at the age of 22 for those born abroad. The judgement, in line with an established case-law, confirms the possibility for Member States to link the retention of national citizenship to the existence of a genuine link between the State of nationality and its nationals again. Does EU law require Member States to limit the award of nationality to persons with a genuine connection to their country and citizens?
