Yes, they are, but children don’t come when their parents it want, because then they would have to wait a long time, rather when theirselves want” - says Géza Csáth in his short story named Te Child. Although the authentical-conservative conditions surrounding the author, complemented with the Csemegi Codex, kept the chances of abortion under strict embargo. However, the legal-ethical dilemma presented in the work is still timeless from the perspective of a century. Te regulation of abortion is a risky jigsaw puzzle where its pieces – representing demography, psychology, morality and necessarily law – are put together by the legislator in the belief of serving legitimacy. However, sometimes one piece of the puzzle gets lost, gets pushed into the background and is lef out of the reckoning. It is no wonder that a thus created, distorted picture is thrown into chaos by the interdisciplinary expansion of the regulation. Te intensive reaction of the Hungarian society to the MI Decree 29/2022 (IX.12.) suggests a similar stumble. It is true that the decree asking for the document of the heartbeat of the fetus, raises plenty of questions, such as its relationship with the constitution and the hierarchy of legal sources, its possible contra legem nature, the confusing circumstances of its legislasion or the disproportionate nature of the psychological crisis it might cause towards women. Among other things, it examines the legal grade of the fetus, the sociological efectiveness of regulation, the possible limits of the woman’s right to self-determination and the Rawlsian defnition of justice are also involved in the chain of thoughts. Additionally, a meta-juridical meaning is also added to the judicial framework: the conficting social, economical and religious sciences and the controversially one-sided legal feminism also belong to our gloss examining the MI. Aiming an objective and calm approach to the subject, this lecture focuses on the foundations of the concept of justice based on the philosophy of law. It explores the sometimes blurred boundaries between state and individual interests and the right to (pro) life and self-determination (pro choice), taking into account the benignly liberal but sometimes blindly ideological conditions of the 21st century. Finally, the treatise points to the remedy for some illnesses: the Swedish model constantly emphasises the possibilities of compromise and prevention. With constructive intentions, this line of thought opens the way to an account of the past and the future without neglecting the comparative international perspective in the spirit of discovering topicality. Eventually, answering the actually concerned question: what constitutional room for manoeuvre can a pregnant woman in contemporary Hungary expect?
