A study on the legal and non-legal binding force of the democratic process and online space in the democratic process. In the state and citizens connection is the question remains to be resolved: how (i.e. by which means) and at which (what level) governance processes citizens can be involved. Beyond the instruments of direct democracy, democratic innovations are are those instruments that do and do not lead to decisions by public authorities seek to deepen the presence of citizens in governance processes levels of governmental governance. Te paper highlights and describes these instruments, highlight their positive aspects in terms of participation and deliberation, and the related dilemma of constitutional law: does it make sense to mere expression of opinion if it is not accompanied by legal binding force.
