The Act 33 of 1871, promulgated on 10 June 1871, created the unified, centralised organisation of prosecutors in Hungary. The new legislation, modelled on the “French ministère public” (similar to the European states of the time), set up prosecuting authorities operating independently of the judicial organisation. The prosecutorial hierarchy was structured according to the organisation of the courts: crown prosecutor; royal attorneys-general; royal prosecutors; deputy crown prosecutors and royal attorneys-general and royal deputy prosecutors. The new prosecutorial organisation started operating on 1 January 1872, under the direction of the Royal Prosecutor General of Pest. The members of the prosecution service were appointed by the King, subject to the approval of the Minister of Justice, and received their salaries from the Treasury. The 1871 Act provided that “until the introduction of oral criminal and civil proceedings, the Crown Prosecutor’s position shall not be filled”. The Crown Prosecutor began his work on 1 January 1900, when the Code of Criminal Procedure of 1896 came into force. The Code of Criminal Procedure assigned the Crown Prosecutor several procedural tasks. He had to be summoned to the hearing in the Curia, and the hearing could not be held without his presence or that of his deputy. In the interests of legal unity, he could appeal to the Curia against any final decision or other measure of the criminal court which was contrary to the law.
