Absztrakt (kivonat)

When the word "lawyer" comes to the surface in everyday life, it certainly ferers to everyone working in the area of law with the required formal acknowledgement. Furthermore, the above-mentioned expression also contains a connotaion related to the legal practice. The question whether how many differentiated legal profession exist is rarely raised and the expression referred to above is a so general collective term that barely covers the whole area of legal practice. Besides, as a consequence, we cannot speak about the problem that there is often a huge difference between the expert knowledge of the certain layers of legal professions and their own specialized knowledge forms an irreconcilable gap between them. Moreover, the question itself is also interesting because in theory the mentioned knowledge and the formal acknowledgement is gained through the same qualification system. Thus, the difference can be separated in two ways between the knowledge of the existing legal professions such as law professors, judges, prosecutors, notaries, lawyers of the public administrations, etc, — just to mention the most traditional oens. On the one hand, it is obvious that different knowledge derives from different practice, which means that the "actors" of the same legal problem consider different procedural issues, not to mention the fact that the people; dealing with legal activity in the specific spheres of society; apply the law in a totally different way. On the other hand, there is a huge gap between the theoretical knowledge related to the law and legal activity and obviously connected to the law professors and between the practical knowledge. This gap is more institutional than being derived from the different practice and seems rather surprising regarding the European traditions. Naturally, the image presented above was much more subtle and nowadays also seems so; there are not only gaps but there are a lot of connecting points as well and these "synapses" can be considered as a token of the development of law. Among other things, the different forms of appearance of law are one of the most important fields of research of comparative law. However, comparative lawyers consider not only the formal sources of law but they pay attention to informal ones as well. What is more these forms of law have an effect on law such as law enforcment. It is important because in many cases legal works have always been considered as informal sources of law, which means that the connecting point can always be set up without or even in contrary of any positive rule. These formal but rather informal connecting points are being analized in this study.
