The Section 50(2) of the Hungarian Constitution provides for the judicial control of the administrative decisions. It does not specifies the exact meaning of either the expression "administrative" or "decision". The concrete effect of the control (nullifying or amending) can also be the subject of constitutional and academic interpetation. This article highlights the possible original meaning (and scope) of the provison with the analysis of the 1988 and 1989 draft-constitutions. Historical aspects and academic interpretation are also dealt with, ending in the conclusion that the constitutional reform of 1989 had (and also missed) the chance to enact a stronger and most expressive judicial function concerning the judicial review of administrative actions. The essential meaning of the judicial control covers a review on the merits. The article emphasises, that the constitutional requirement of the review on the merits could be better fulfilled with the establishment of a separate Administrative Court.
